Skiing Liability Waiver and Insurance Acknowledgment

1. Acknowledgment of Risk

I, the undersigned, acknowledge that skiing is an inherently dangerous activity that involves a significant risk of injury.

2. Confirmation of Insurance Coverage

I hereby confirm that I have obtained appropriate and sufficient insurance coverage that includes, but is not limited to, medical expenses, emergency evacuation, and liability for any injury, damage, or loss that may occur while participating in skiing activities. I understand that this coverage is my responsibility and that Cavendish will not be liable for any costs, damages, or losses that may result from inadequate or insufficient insurance coverage.

3. Waiver of Liability

In consideration of being allowed to participate in skiing activities organized or facilitated by Cavendish, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby voluntarily waive, release, and discharge Cavendish and its directors and employees personnel ("Released Parties") from any and all liability, claims, demands, or causes of action that may arise from injury, loss, or damage to myself or my property however caused while participating in skiing activities provided that nothing in the foregoing shall limit Cavendish’s liability for personal injury or death to the extent caused by its negligence.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims, demands, or causes of action that may be brought against them as a result of my participation in skiing activities, including but not limited to claims arising from my own negligence or failure to have adequate insurance coverage.

5. Assumption of Responsibility

I fully understand and agree that it is my responsibility to evaluate the safety and appropriateness of my participation in skiing activities, including ensuring that my equipment is in good working condition and that I am physically fit and adequately trained to engage in such activities.

6. Medical Authorisation

In the event of an emergency, I authorise Cavendish or its representatives to obtain medical treatment on my behalf. I acknowledge that I am responsible for any medical expenses incurred as a result of an injury during the skiing activities, and that my insurance coverage is adequate to cover such expenses.

7. Governing Law

This waiver and release shall be governed by and construed in accordance with the laws of England and Wales, and any legal action arising out of or relating to this waiver shall be brought exclusively in the courts of England and Wales.

8. Entire Agreement

This waiver and release constitutes the entire agreement between myself and Cavendish with respect to the subject matter hereof and supersedes any prior or contemporaneous agreements, understandings, or representations.

9. Severability

If any provision of this waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
